Terms and Conditions of Membership
Chapter 1: General Provisions Article 1 (Purpose) These Terms of Use (hereinafter referred to as "Terms") aim to specifically define the conditions for membership and use of services (hereinafter referred to as "Website") provided by KDC CO. LTD (hereinafter referred to as "the Company") to its users (hereinafter referred to as "Members"), as well as other necessary matters. Article 2 (Definitions of Terms) 1. The terms used in these Terms are defined as follows: ① "Member" refers to a user who agrees to these Terms and uses the Services. ② "Service Agreement" refers to all agreements concluded between the Company and the Member regarding the use of the Services, including these Terms. ③ "User ID" refers to a unique combination of letters and numbers assigned by the Company to each Member upon the Member's request for identification and service use. ④ "Password" refers to a unique combination of letters and numbers set by the Member and registered with the Company to verify the identity of the Member identified by the User ID. ⑤ "Device" refers to computing equipment such as personal computers, PDAs, and mobile phones used by the Member to access the Services. ⑥ "Termination" refers to the cancellation of the Service Agreement by either the Company or the Member. 2. Terms used in these Terms that are not defined in Paragraph 1 shall be interpreted in accordance with relevant laws and regulations and service-specific guidelines, and otherwise, in accordance with general custom. Article 3 (Effectiveness and Amendment of Terms of Use) 1. These Terms become effective upon their online publication via the Website, the Member's consent, and the Company's acceptance. The Company may revise these Terms within the scope not violating relevant laws and regulations if a reasonable cause arises. The amended Terms shall become effective upon public notification through the Website following due process. 2. Members must regularly visit the Website to check for changes to the Terms. The Company is not responsible for any damages incurred by Members due to their failure to be aware of changes to the Terms. 3. If a Member does not agree to the amended Terms, they may request membership withdrawal (termination). Article 4 (Application of Other Rules) The Company may, if necessary, establish separate terms or operational principles (hereinafter referred to as "Service-Specific Guidelines") for individual items within the Services. In cases where these Terms conflict with the Service-Specific Guidelines, the Service-Specific Guidelines shall take precedence. Chapter 2: Conclusion of Service Agreement Article 5 (Formation of Service Agreement) 1. The Service Agreement is formed upon the user's consent to the contents of the service application and the Company's acceptance of the application. 2. Consent to the Service Agreement is expressed by clicking the "Agree" button on the application form at the time of application. Article 6 (Application for Service Use) 1. Users who wish to become Members and use the Services must provide all information requested by the Company (User ID, password, name, contact information, etc.). 2. All Members must provide their true personal information to use the Services. Members who misappropriate others' information or register false information, or otherwise fail to register their true information, cannot assert any rights related to service use and may be subject to penalties under relevant laws and regulations. 3. Membership registration must be done only through the Member's true information, and the Company may take verification measures regarding the information registered by the Member. Members must actively cooperate with the Company's verification measures, and if they fail to comply, the Company may treat the information registered by the Member as fraudulent. 4. The Company may differentiate service use for Members by dividing them into grades, varying usage time, number of uses, and service menus. Article 7 (Protection and Use of Personal Information) 1. The Company strives to protect Members' personal information in accordance with relevant laws and regulations. The protection and use of personal information are governed by relevant laws and the Company's personal information protection policy. However, the Company's personal information protection policy does not apply to linked sites other than the Company's official website. Furthermore, Members must thoroughly manage their passwords to prevent exposure to others, and the Company is not responsible for information exposed due to the Member's negligence. 2. The Company may provide Members' personal information to third parties within the scope permitted by law in the following cases: ① When requested to provide information by investigative agencies or other government agencies. ② When necessary for information protection tasks, including verifying illegal activities, such as a Member's violation of laws or these Terms. ③ When otherwise required by law. Article 8 (Approval and Restriction of Service Application) 1. The Company shall, in principle, approve service applications in accordance with Articles 5 and 6, based on the order of receipt, provided there are no operational or technical impediments. 2. The Company may withhold approval in the following cases: ① If the applicant intends to use the Services for fraudulent purposes. ② If the applicant intends to use the Services for profit-seeking purposes. ③ If the applicant is a user in a competitive relationship with the Services. ④ If the applicant is a user whose Service Agreement was previously terminated due to a violation of laws or these Terms. ⑤ If the application violates any other prescribed general matters. 3. The Company may suspend approval for service applications in the following cases until the reason for approval restriction is resolved: ① If the Company has insufficient equipment capacity. ② If there are technical impediments for the Company. ③ If service approval is difficult due to other reasons attributable to the Company. 4. The Company may withhold approval if the applying customer is a minor as defined by relevant laws and regulations, in accordance with service-specific guidelines. 5. The Company may revoke service approval if any reason listed in Paragraph 2 is discovered after the membership registration process is completed. Article 9 (Assignment and Change of User ID, etc.) 1. The Company shall assign User IDs to Members in accordance with these Terms. 2. User IDs are, in principle, unchangeable. If a change is unavoidable, the Member must terminate the existing ID and re-register. 3. The Website's User ID may be linked to the Member ID of sites operated by the Company or its capital affiliates with the Member's consent. 4. The Company may change or suspend the use of a User ID at the Member's request or at the Company's discretion in the following cases: ① If the User ID is registered as a phone number or resident registration number, raising privacy concerns. ② If the User ID causes disgust to others or violates public morals. ③ If the User ID is identical to or likely to cause confusion with the name of the Company, its services, or service operators. ④ If there are other reasonable grounds. 5. Members are responsible for managing their User ID and password. The Member is liable for any damages incurred during service use or fraudulent use by third parties due to negligent management, and the Company is not responsible for such damages. 6. Other matters regarding the management and changes of Members' personal information shall be governed by service-specific guidelines. Chapter 3: Obligations of Contracting Parties Article 10 (Obligations of the Company) 1. The Company shall ensure that Members can use the Services on the requested service commencement date, unless there are special circumstances. 2. The Company shall promptly repair or restore any damaged or lost equipment for continuous and stable service provision, unless there are unavoidable reasons. 3. The Company shall establish a security system for personal information protection and publicly announce and adhere to its personal information protection policy. 4. The Company shall immediately process opinions or complaints raised by Members through appropriate procedures if they are objectively deemed legitimate. However, if immediate processing is difficult, the Company shall notify the Member of the reason and processing schedule. Article 11 (Obligations of Members) 1. Members must provide their true information based on facts when applying for membership or changing member information. If false or others' information is registered, they cannot assert any related rights. 2. Members must comply with the provisions of these Terms and other regulations established by the Company, announcements made by the Company, and relevant laws, and must not engage in acts that interfere with the Company's operations, damage the Company's reputation, or harm others. 3. Members must immediately notify the Company of any changes to their service agreement details, such as address, contact information, or email address, through the appropriate procedure. 4. Members may not use the Services for business activities without the Company's prior consent, and the Company is not responsible for the results of such business activities. Furthermore, if the Company incurs damage due to such business activities, the Member shall be liable to the Company for damages, and the Company may restrict service use for the Member and demand compensation for damages through lawful procedures. 5. Members may not transfer or donate their right to use the Services or their status under the service agreement to others, nor may they provide it as collateral, without the Company's express consent. 6. Members must not infringe upon the intellectual property rights or other rights of the Company or third parties, nor engage in any acts corresponding to the provisions of Article 18. Chapter 4: Use of Services Article 12 (Service Usage Hours) 1. Service use is, in principle, available 24 hours a day, 7 days a week, unless there are special operational or technical impediments for the Company. However, the Company may temporarily suspend services on days or times designated by the Company for regular system maintenance, expansion, or replacement, and such planned service interruptions will be announced in advance through the Website. 2. The Company may temporarily suspend all or part of the Services without prior notice in unavoidable circumstances such as urgent system inspections, expansion and replacement, equipment failure, service overload, national emergency, or power outage. 3. The Company may suspend the provision of all or part of the Services after prior notice to Members if necessary for service operation, such as service reorganization. Article 13 (Member's Posts, etc.) 1. "Posts" refer to articles, photos, various files, and links posted by the Member while using the Services. 2. If the Member's posts registered on the Services cause damage or other problems to the Member or others, the Member shall be responsible for them, and the Company is not responsible for them unless there are special circumstances. 3. The Company may take relevant measures, such as temporary suspension, modification, deletion, relocation, or refusal of registration, regarding posts corresponding to the following clauses, without the Member's prior consent: ① If the content severely insults or damages the reputation of another Member or a third party. ② If the content distributes or links to content that violates public order and morals. ③ If the content promotes illegal copying or hacking. ④ If it is an advertisement for commercial purposes. ⑤ If the content is objectively deemed to be related to a crime. ⑥ If the content infringes upon the copyrights or other rights of other users or third parties. ⑦ If the content consists of private political judgments or religious views deemed incompatible with the nature of the Company's services. ⑧ If the content violates the posting principles stipulated by the Company or does not conform to the nature of the bulletin board. ⑨ If the content is otherwise deemed to violate relevant laws and regulations. 4. If the Company receives a request for post suspension from a third party due to defamation, infringement of intellectual property rights, etc., it may temporarily suspend the post (transmission suspension). If a lawsuit, settlement, or other similar decision by a relevant agency occurs between the post suspension requester and the post registrant and is received by the Company, the Company will comply. 5. If a post is temporarily suspended, the Member who registered the post may request the Company to re-post (resume transmission). If a re-posting request is not made within 3 months from the date of suspension, the Company may delete it. Article 14 (Copyright on Posts) 1. Copyright and other intellectual property rights to posts or works created by the Company belong to the Company. 2. The copyright of posts published by a Member within the Services belongs to the Member who published them. However, for the purpose of operating, displaying, transmitting, distributing, and promoting the Services, the Company may use the posts registered by the Member free of charge within a reasonable scope, consistent with fair practice as stipulated in copyright law, without the Member's separate permission, as follows: ① Reproduction, modification, alteration, display, transmission, distribution, and creation of editorial works within the Services without harming the originality of the Member's posts. ② Providing, displaying, or promoting the content of the Member's posts to service partners such as media and telecommunication companies. However, in this case, the Company does not provide the Member's personal information other than the Member's User ID without separate consent. 3. If the Company intends to use a Member's post by methods other than those in the preceding paragraph, the Company must obtain the Member's prior consent through methods such as phone, fax, or email. 4. If a Member terminates the service agreement, all posts recorded in their account (e.g., mail, blog, my home) will be deleted. However, this does not apply to posts re-posted or copied by others, posts provided in combination with others' posts, or posts registered on public bulletin boards. Article 15 (Provision of Information) 1. The Company may provide Members with various information deemed necessary for service use through methods such as email, letters, mail, SMS, or phone calls. 2. The Company may collect additional personal information with the Member's consent, in accordance with relevant laws and regulations, for purposes such as service improvement and service introduction to Members. Article 16 (Advertisement Placement and Transactions with Advertisers) 1. Part of the service investment base that enables the Company to provide services to Members comes from revenue through advertisement placement. Members agree to the placement of advertisements exposed during service use. 2. The Company is not responsible for losses and damages incurred when a Member participates in or communicates or transacts with advertisers' promotional activities placed on or through the Services. Chapter 5: Termination of Contract and Restriction of Use Article 17 (Contract Change and Termination) 1. If a Member wishes to terminate the service agreement, the Member must cancel their membership using the [Member Information] menu within the Services. 2. If the Company terminates the service agreement, it shall cancel the Member's registration in accordance with the Website's personal information protection policy. In this case, the Company shall notify the Member, and if the Company intends to terminate the service agreement ex officio, it shall provide the Member with an opportunity to explain before cancellation. Article 18 (Service Use Restrictions) If a Member violates Article 11 of these Terms in their service use or falls under any of the following clauses, the Company may restrict service use, initialize, terminate the service agreement, and take other appropriate measures: ① Registering fraudulent content in member information, misappropriating another person's User ID, password, or other personal information, or trading or providing a User ID to others. ② Transmitting, posting, emailing, or otherwise distributing to others vulgar or obscene content, or content that may infringe upon the reputation or privacy of others, including information, text, graphics, audio, or video, that violates public order and morals. ③ Harassing or threatening other users, or persistently causing distress or inconvenience to a specific user. ④ Modifying the Company's client programs without special authorization from the Company, hacking the Company's servers, or arbitrarily changing part or all of the website or posted information. ⑤ Reproducing information obtained through the Services for purposes other than service use without the Company's prior consent, or using it for publication, broadcasting, etc., or providing it to third parties. ⑥ Impersonating the Company's management, employees, or related persons, or intentionally interfering with the Services, thereby disrupting normal service operation. ⑦ When there is a request for correction from a relevant public institution such as the Korea Communications Standards Commission. ⑧ If the Service has not been used for more than 6 months. ⑨ If the Website is used solely as a file data repository by simply uploading data. ⑩ Violating any laws and regulations, including violating the general regulations set by the Company (including these Terms), or engaging in acts objectively deemed to be related to a crime. Chapter 6: Damages and Other Matters Article 19 (Damages) 1. The Company and the user shall compensate each other for damages caused by intent or negligence in connection with service use. 2. However, the Company is not responsible for any damages related to the use of services provided free of charge, as long as it does not violate the provisions of the personal information protection policy. Article 20 (Disclaimer) 1. The Company is exempt from responsibility for providing services in cases where it cannot provide services due to natural disasters, war, suspension of services by telecommunications carriers, and other equivalent force majeure events. 2. The Company is exempt from responsibility for damages caused by unavoidable reasons such as repair, replacement, regular inspection, or construction of service facilities. 3.The Company is not responsible for damages caused by Member's computer errors, or damages caused by the Member's inaccurate entry of personal information and email addresses. 4. The Company is not responsible for the Member's failure to obtain expected profits or loss of profits from using the Services, nor is it responsible for damages caused by data obtained while using the Services. 5. The Company is not responsible for the reliability, accuracy, or other content of various information, data, or facts posted by the Member on the Services. The Company has no obligation to intervene in disputes arising between Members or between Members and third parties through the Services, and is not responsible for compensating for damages resulting from such disputes. 6. The Company is not obligated to pre-screen Member's posts before registration or to constantly check or review the content of posts, and is not responsible for the results thereof. Article 21 (Notices) 1. When the Company sends a notice to a Member, it may do so via the email address registered by the Member with the Company. 2. If the Company needs to send a notice to an unspecified number of Members, it may substitute individual notices by posting the notice on the public bulletin board for more than 7 days. Article 22 (Jurisdiction and Governing Law) 1. Matters not specified in these Terms shall be governed by the relevant laws of the Republic of Korea, such as the Telecommunications Business Act, and commercial customs. 2. For Members of the Company's fixed-rate services and other paid service users, separate terms and policies established by the Company shall apply concerning the relevant services. 3. In the event of a lawsuit arising from a dispute related to service use, the Seoul Central District Court of the Republic of Korea shall have jurisdiction. < Supplementary Provisions > 1. These Terms will take effect on August 1, 2025.
